1. Overview

These Terms of Service ("Terms") govern your access to and use of the Big & Comfy website, products, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services. Big & Comfy reserves the right to update these Terms at any time, and continued use constitutes acceptance of any changes.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to make purchases through our Services. By placing an order, you represent that you are legally capable of entering into binding contracts. If you are using the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. Products and Orders

All product descriptions, images, and specifications are provided for informational purposes and represent our best effort to accurately depict each item. Colors may vary slightly due to display settings and photography lighting. Prices are subject to change without notice. Orders are subject to acceptance and product availability. We reserve the right to cancel or refuse any order for reasons including but not limited to inventory limitations, errors in product or pricing information, or concerns about fraud or unauthorized activity.

4. Shipping and Delivery

Shipping timelines are estimates and not guaranteed. Actual delivery dates depend on carrier schedules, destination, and external factors beyond our control. Title and risk of loss pass to you upon delivery to the carrier. You are responsible for providing accurate shipping information. Additional fees may apply for re-delivery, address corrections, or refused shipments.

5. Returns and Refunds

We accept returns of unused, undamaged products in original packaging within the timeframe specified in our Trust & Policies page. Custom orders, made-to-order items, and final sale products may not be eligible for return. Refunds will be issued to the original payment method within 7-10 business days after we receive and inspect the returned item. Shipping costs on returns may be the customer's responsibility unless the return is due to a defect or error on our part.

6. Warranty

Big & Comfy provides a limited lifetime warranty on structural components of our seating products when used under normal residential or commercial conditions as intended. The warranty covers manufacturing defects in materials and workmanship but does not cover normal wear and tear, misuse, abuse, alterations, or damage caused by improper cleaning or environmental factors. Warranty claims must be submitted with proof of purchase and a description of the defect.

7. Intellectual Property

All content on this website, including but not limited to text, graphics, logos, images, product designs, and software, is the property of Big & Comfy or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from any content without express written permission. The Big & Comfy name, logo, and product designs are trademarks of Big & Comfy.

8. User Conduct

You agree not to use the Services for any unlawful purpose or in any manner that could damage, disable, or impair the Services. Prohibited activities include but are not limited to: attempting to gain unauthorized access to our systems, interfering with other users' access, transmitting malware or harmful code, harvesting personal information, or engaging in fraudulent transactions. We reserve the right to suspend or terminate access for violations.

9. Limitation of Liability

To the fullest extent permitted by law, Big & Comfy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Services, even if advised of the possibility of such damages. Our total liability for any claims arising under these Terms shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to the personal jurisdiction of such courts.
